In the name of god Amen I William Wallton of Somerset County in the
province of Maryland and, being very Sick & weake but thanks be unto god of
perfect sound Mind & Memory & knowing the uncertainty of this Life & that
all flesh must yield to death for the better Setting yr Temperell Estate
god Allmighty hath blefsed me wth after my Just debts are duly pd I do Make
& ordain this my Last will & Testamt in Manner & form foll: ~ Revoaking &
Making Null & Void all former Wills & Testaments & this onely to remain &
be my Last Will & Testamt ~~~
Impr I give my Soul to god that gave it me & my body to ye Earth from
whence it came there to be burried in such Christn manner as My Executor
hereafter Mentioned shall think fitt, hoping & veryly beleiving at the Last
day through ye Merritts death & passion of My blessed Saviour & Reedeemer
Christ Jesus it shall be raised up again in Glory ~~~
Item I give & Devise unto my Loving son John Wallton his heirs & assigns
for Ever four hundred Acres of Land Lying & being on ye Seabourd Side being
part of ye devident Whereon I now Live in A neck called by the Name of the
Indian Cabbin, Neck bounded Sourtherly, With the Land of Wm. Courde runing
from the Mouth of a Creek next to the Land of Wm Coude & thence Extending
Northerly Along the sea board or Bay Side to the Next creek flouing out
thence & so up the same & that Branch of the said Creek next unto the
plantation whereon I now Live & up that branch so far as the ground is Now
cleared & from thence by A Line drawn to the Westermost bounds of my said
Land for Length to make the full quantity of four hundred acres of Land as
afsd & for that remaining part of ye devident Whereon I now Live I give &
devise unto my Lov: Son Fisher Wallton his heirs & afsigns for Ever & in
case it should so happen yr Either of my afosrd sons John or Fisher Wallton
should dye before they Attain to the age hereafter mentioned then my will
is that the survivour of them should have possess & injoy the deceases prt
to him his heirs & assigns for Ever ~~~
Item: I give & devise to my Lo: son William Wallton his heirs & assigns for
Ever Seven hundred Acres of Land being the one half of a devidend of Land
called Neighborgood being the Northern pt there of near the head of a Neck
called senapuxon, & for the Remaining pt of that Seven hundred acres called
Neighbourhood, I give & devise to my Lo: Son Stephen Wallton his heirs &
assigns for Ever & In case it should soe happen that if either of my Two
sons Last Mentioned vzt William or Stephen Wallton should dye before they
attain to the age hereafter Mentioned then my will is that the Survivour of
them should have & Injoy the deceasts pt to him his heirs & assigns for
Ever ~~~
Item, My will is that the Two hundred & fifty Acres of Land lying & being
at Boggetonorton wch I bought of Hen: Bishop sen. to be settled in some
Conveinent time after my decease by My Executrix hereafter mentioned & that
ye produce there of may be Imployed for my Loving Children Education &
Learning & that one young house & Mare may in the like Manor or dispose of
to & for that end & purpose ~~~
Item I give & bequeath to my Lo: Son John Wallton ye Gold ring which was my
fathers, having the Two Letters I W thereon & for my Wifes better
Accomidation of Living I Will that she have use possess & Enjoy the
plantation whereon I now Live ~~~
Item for the Remaining pt of my Estate of Wh Quallity or Specie Soever it
be, my will is that it be Equally devided between my well beloved wife
Rebecca Wallton & my four Lo: sons John: Wm. Stephen and Fisher Wallton
to be equally divided & shared Amongst ye as they shall successively Attain
to the age of Sixteen years at which term or time my will is that each of
my aforsd Children peaceable & quietly have use posses & Enjoy his
pertecular pt & porton either reall or personall devised or bequeathed
Intended to be devised or bequeathed as by this my Last will & Testament

Lastly I leave my well beloved wife Rebecca Wallton the whole & sole
Executrix of this my Last will & Testament In Wittness where of & others
the before Recited Premises I have hereunto afixed my hand & Seale the

This day came before me Capt. Wm Whittington Wm Cord & John Robert & Made
Oath that they saw Wm Wallton late of this County in his life time Sign &
Seale A certain Instrument declaring it to be his Last will & Testament
bearing date the Tenth day of Aprill 1686. This taken & don by virtue of an
Order from the Honble Henry Darnett & Clemt Hill Judges for probate of
Wills bearing date the fourteenth day of Augt 1686 & under there seale of
of [sic] office given under my h& & seale this 25th of Augt 1686 ~~~

Maryland in Somerset County Memorand that John Roberts one of the Witnesses
to the within Mentioned Will being lately deceased the other Two to sit
Capt Wm ~ Whittington & Wm Cord Came before me the last day of February
1687/8 & made oath that they saw the testator Wm Walton within named both
Sign & Seale the sd Will & did there hear him declare the same to be his
Last will & Testamt ~~~
This day being the 10th Day of March 87/8 Came before me Rebecca Carrell
the rellique of Wm Walton Within mentioned & Executrix In the within will
named & appointed & made Oath virbatum According to the form of the Oath of
an Executrix This day being the 12th day of March Appeared before me Mathew
Scarbrough & John Townsen Appraisers of the goods & Chattles of Wm Walton
aforesd & Made oath ~ According to the form Accostomed Annoq Domo 87/8 ~~~
