In the name of God Amen this the 28th of September 1733 I William Smith
of Somerset County in ye Province of Maryland being in my ordinary
Sences but weak in Body at present Blessed be God for it yet knowing the
uncertainty of this life and being desirous to settle and leave things
in order do make this my last Will and Testament in manner & form
following First and principal I commend my Soul to God Almighty my
Creator assuredly believing that I shall receive full and free Pardon of
all my Sins and be saved by the precious Death and merits of my Blessed
Saviour and Redeemer Jesus Christ and my Body to the Earth from whence
it was taken to be buried after a decent and Christian manner by my
Executors hereafter named and as touching this Worldly Estate as the
Lord in his Mercy hath lent me this is my Will that it be bestowed as
hereafter is Expresed I Leave and bequeath to my Son William Smith this
Plantation whereon I live called Hartellbery and the other Tract called
Addition to him and his heirs for Ever Except a part of the head of
Hartelbery ye Bounds & Line known already that I Leave and bequeath to
my Cousin Thomas Smith Junr. I Leave and bequeath my Mill stones to my
Son William Smith and to his heirs for ever as also I leave my two Guns
to my Son William and all the rest of my moveable Estate I Leave to be
divided one third part to my Wife and the other two parts to my Son and
I do Constitute and appoint my beloved Wife Magdalen Smith to be my
Executor of this my Last Will and Testament making void all other former
Wills by me made by word or writing in Witness whereof I have hereunto
Set my hand & Seal the Day and year above written Signed and Sealed

in presence of us James Train, Thomas Smith, John Gray. April ye 15th
1734 Came James Train Thomas Smith and John Gray Subscribing Evidences
to the above Will and made Oath on the Holy Evangels of Almighty God yt
they Saw the Testator William Smith Sign and Seal and heard him publish
pronounce and declare the above Instrument of writing to be his last
Will and Testament and that at the time of his so doing he was to the
best of their apprehension of sound disposing mind memory and
understanding and that they the afsd James Train,Thomas Smith ,& John
Gray, Subscribed this Will in ye presents & at ye Request of the
Testator William Smith. Sworn before me Nehemiah King Depy Commissary of
Som: County April ye 15th 1734 / Then came Magdalen Smith Extx of Wm
Smith late of Som: County deceased and made her Election yt she was well
contented wth the Will of her Husband relating to his personal Estate
but Claimed her Right of Dower in his real Estate he having made no
provision for her in his Will on the other side mentioned touching his
