[Margin:] Sampson Waters Will 2080 In the Name of God Amen The Twelfth day of August Anno Domini one thousand Six hundred ninety and three And in the Fifth year of the Reign of our Soveraign Lord and Lady William and Mary King and Queen of England, Scotland, France and Ireland Defenders of the Faith &c. I Sampson Waters of Boston in the County of Suffolke in the Province of the Massachusetts Bay in New England Mariner being sick in body, yet of good, perfect and sound memory Praises be given to God therefor. Do make this my present Will and Testament And do revoke, disannul and renounce all former and other Wills and Testaments whatsoever by me heretofore by me made in word writing or otherwise And make and ordain this to be my very true last and only Will and Testament in manner and forme following. That is to say Imprimis I commend my Soul into ye hands of Almighty God my Heavenly Father of whose mere and only Grace I trust to be saved and received into eternal rest through the death and merits of my Saviour and Redeemer Jesus Christ in whose precious blood I set the whole and only hope of my Salvation And my body in hope of a joyful Resurrection I commit to the Earth to be buried with such Charges and in such manner as my Executors hereafter named shall think fit. And as touching the distribution of my outward Estate which it hath pleased the Lord to lend me I dispose of the same as followeth. First after my just Debts and Funeral Charges are paid, I give unto my Deare and Well beloved Wife Rebecca Waters, the use, possession and occupation of all my Estate Real and Personal for and during the whole term of her Widowhood. And if she shall remain a Widow during her natural life Then I do give her liberty power and authority to make her Will and to dispose of one third part of my sd Personal Estate among those Children which she shall esteem most deserving. But in case my sd Wife Rebecca shall contract a second Marriage Then I do give and bequeath unto her the Third part of my Personal Estate for ever, and the Thirds of my Real Estate during her natural life, and no more. Item I give and devise unto my two Sons John and Sampson Waters my House Land and Wharfe and appurtenances (The which Land I bought of Alice Thomas of Boston widow) to be equally divided between them. But if in case either of them shall dye before the other without Issue It is my Will that the Survivour of them shall then enjoy the decd his moity or half part of the sd House Land and Wharfe. And if it shall so happen that they the sd John and Sampson Waters shall both dye without...Issue, and they or either of them shall be married It is my Will that after the death of their Wife or Wives, that the sd House Land and Wharfe shall be given and equally divided between such of my Daughters as then remain alive And in case of their death, To such of my Grand Children as shall then be alive, and to be equally divided amongst them and to be and remain to their heires and assignes for ever. Item I give and bequeath unto each of my four Daughters Vizt Mary, Rebecca, Ann and Elizabeth the Sum of Threescore pounds currant money of New England, to be paid out of my Estate unto each of them when my Executors hereafter named shall think fit. And It is my Will that those of them that are under age shall be brought up and provided for out of my Estate, until they arrive to age or are married. Item It is my Will that all my Plate shall be divided equally between my sd two Sons and four Daughters, or such of them as shall be alive at the decease of my sd Wife Rebecca. But if in case my sd Wife shall remarry and take her Thirds. Then it is my Will that the other Executor shall forthwith set out and divide the two Thirds of the sd Plate remaining to each of my Children that are alive in equal proportion Item I give unto my two Grand Children Sampson Jervais and John Jervais Five pounds apiece currant money of New England. To be paid to them by my Executors in some reasonable time according to ye discretion of my sd Executors. And as to my Land and Estate in Somerset County in Nantecoke River in Virginia I do hereby authorize and impower my Executors hereunder named or either of them, their or either of their Assignes to sell and dispose of the same And Lastly I make and ordain my Deare and Welbeloved Wife Rebecca Waters and my loving Son John Waters to be my full, whole and only Executors of this my last Will and Testament. And my Honoured Father in Law William Ireland of Rumney Marsh and my deare and loving Friend Thomas Pecke of Boston aforesd I make and ordain overseers of this my last Will and Testament And I give unto my sd overseers Twenty Shillings apiece to buy them a Ring. In Witness whereof I have hereunto subscribed my name and set my Seal in the presence of these Witnesses whose names are hereunto subscribed Sampson Waters and a Seal.
