Transcription
In the Name of God Amen I Roger Philips of Stepney Parish on the County of
Somerset and province of Maryland planter being sick and weak of body yet
of sound and perfect mind, and memory praise be therefore given to almighty
god doe make and ordain this my present Last Will and Testament in manner
and form following that is to say fist and principally I comend my soul
unto the hands of Almighty god hoping through the meritts death and passion
of my saviour Jesus Christ to have full and free pardon and forgiveness of
all my sins and to inherit everlasting, life and my body I comit to the
earth to be decently buried a the discrestion of my Executors hereafter
mentioned and as touching the dispisition of all such temporal Estate as it
hath pleased Almighty God to bestow upon me. I give and dispose thereof as
followeth___
First I will that my debts and funerall charges shall be paid and
discharged ____
Item I give to my beloved Wife Darrothy Philips the best feather bed and
furniture thereunto belonging and likewise to my said wife, I give my own
saddle horse called Brandy Item I do give and bequeath to my son Richard
Philips one white horse called Pistol with a saddle, bridle sword and
pistols and houlsters and a gun called my gun, all to be t his disposing
after my decease ___
Likewise I do give and bequeath to my so Richard Philips the plantation
wherein I now live with all rights profits and privileges thereunto
belonging to him the sd. Richard Philips and his heirs for ever.
Containing by estemation one hundred acres more or less and likewise, I doe
give and bequeath to my son Richard Philips and to Sarah Philips my young
daughter all that tract dividend or parcell of land adjoining to the
plantation or tract whereon I now live, which I purchased of Simon Perkins
and twenty five acres of Marsh which I took up joying to the said tract
aforesaid___ to be equally divided between son Richard Philips and my
youngest Daughter Sarah Philips with all rights profits and privileges
thereunto belonging to with all rights profits and privileges thereunto
belonging to the said Richard and Sarah and to their heirs forever provided
the land Sarah Philips do dye without isues of her body honorably begotten
them the said parcell or tract of one hundred acres with quality of Marsh
thereunto belonging shall fall in course to the said Richard Philips and to
his heirs forever, and likewise it is my Will that if the said Richard
Philips shall dye without honor of his body that then the said Sarah
Philips shall enjoy all the plantation and tracts of or parcells of land
and march which yearly belongeth to the said Richard Philips given and
bequeathed at aforesaid to her the said Sarah Philips and to her heirs
forever.
Item I do give and bequeath unto my eldest son Thomas Philips and to my
Daughter Dorothy Philips all that tract dividend or parcell of land lying
on the north side of a Ridge called Tamieoons Ridge known by the name of
Oxbury with all rights and privileges thereunto belonging to be equally
divided betwixt them the said Thomas and Dorothy and to their heirs for
ever provided also that if the said Dorothy Philips shall dye without issue
of her body honestly begotten them the said Thomas Philips shall enjoy all
the said tract aforesaid to him and his heirs forever, and my will is that
if the said Thomas Philips shall dye without heirs of his body then the
said Dorothy Philips shall enjoy all the said promises aforementioned to
her and her heirs for ever.
Item I do give and bequeath to my Daughter Pheby Philips all that tract,
divided or parcell of land called Smithfield lying on the south side of
Yaiarsons Ridge with all rights profits and privileges thereunto belonging
to her the said Pheby Philips and to her heirs for ever provided allways
that neither she the said Pheby Philips her heirs or assigns shall disturb
or molest John Ditton which is now seated upon the sd. dividend of his land
of was according to the tenor of his lease at by her written deed of lease
doth att large appear.
Item I do give to my son Thomas Philips att my decease one tow year old
heifer with all her future increase to him and his heirs forever.
Item I do give to my Daughter Elizabeth Crouch att my decease one cow and
to my grandchild Elizabeth Crouch Jun. one cow calfe att my decease with
all her future increase male or female.
Item I do ordain and appoint my beloved wife and my son Richard Philips
to be my Executrix and Executor of this my Last will and Testament.
Likewise my will that if it should please god that before my decease or
after a negro woman should be purchased out of this said Estate and the
said negro woman should bring children my will is that my daughter Pheby
shall have the first child the said woman shall bring and my Daughter
Dorothy the next child the said negro woman shall bring and likewise my
will is that after the decease of my wife my son Richard shall have the
negro woman and my daughter Sarah the negro woman and my will is that if
any more negroes can be purchased by me and or after my decease by my
Executors before my laid three Daughters shall come to age of seventeen
years then my said daughters which is not att age and have not recd. their
portions shall have there shares in the said negro or negroes after the
decease of my wife all the rest and residue of my personal Estate I give to
be equally divided between my loving wife my Executrix and my son Richard
whom I leave joint Executor with his mother and my three daughters to witt
Pheby Philips, Dorothy Philips and Sarah Philips.
And my will is that my son Richard if god spares him life shall live with
his mother upon my now plantation will he come to the age of own and twenty
years except he marrys or his mother marrys
Likewise my will is that my loveing wife shall enjoy the plantation whereon
I now live during her life
Likewise I do desire Thomas Horsman and William Kible to be assistants to
my Executors to see this my Last Will and Testament duly performed
And I do hereby revoke disanull and make void all former wills and
Testaments by me heretofore made in wittness whereof I the sd. Roger
Philips to this my last Will and Testament sett my hand and Seale this
fourteenth day of October Ano Dini 1698.

On the back of the above Will was thus Endorsed Viz.
Be it known unto all men by these presents that as whereas I Roger Philips
of the County of Somerset and province of Maryland planter have made and
declared my said Last Will and Testament in writing bearing sate the 14th
day of October 1698. I the said Roger Philips do by these presents
codecill and ratifie my said Last Will and Testament and do give and
bequeath unto my Eldest Daughter Elizabeth Philips alias Crouch and to her
heirs forever all that parcell tract or dividend of land called Haphazard
containing one hundred and twenty five acres more or less as p pattens doth
appeare with all rights profitts privileges and benefitts thereunto
belonging to have and to hould the said tract of dividend to land with all
its appurtunances t her the said Elizabeth Philips alias Crouch and to her
heirs for ever and my Will and meaning it that this codicill or schedule be
and be adujudged to be part and parcell of my said Last Will and Testament
and that all things herein contained and mentioned be faithfully and truly
performed at fully and amply in every respect as if the same was t declare
and sett down in my said Last Will and Testament In wittness whereof I the
said Roger Philips have thereunto sett my hand and seale this 31st day of
December Anno Dnd. 1699
