In ye name off God Amen ye 23 day of february 1686 I John Osbourn off Somersett County being weak of body but of good memory and knowing that all men hast appointed tyme dept alone constitute ordaine and declare this to be my last will and testament in manner and form following ~ Impr I make null void and (?) effect all other wills testaments and codicills whatsoever heretofore made by me and declared either by word or writting ~ Item being Sworne full and from my head penitent for all my Sins desirving forgivenefs of the same I command my Soul to god that gave it and my body to ye ground to be (?) intend hoping through ye meritts of my Saviour Jesus Christ for the (?) day off Resurrection Item as to ye settling my estate and such goods chattles (?) as is (?) (?) god for alone my (?) to bestow upon me I do order give bestow and dispose ye same in manner and form full: Impr I constitute order and appoint my dear wife Attalemta my whole and sole Executrix of this my last will and testament ~ Item Item I leave give and bequeath all my personall estate as goods chattles debts and that I have as preset or may have in reversion unto my said wife Attalemta and Martha my daughter to be divided equally between them ~ Item but whereas my said wife is great wth child mow if the said child shall be born alive my Will then is that the said estate shall be divided there in equall parts and the said child to have one share ~ Item I will that my said Executrix any other by her order shall have Lycense and are hereby empowered to sell make title and dispose off one tract or dividend off land adjoining upon (?) creek and turning twelve hundred acres off land it being for the paying debts, and other (?) that necefsarily will insue upon my death; as funerall changes probate off will and ~ Item iff in case any more debts should ensue I impower my said wife and executrix to sell and make title off my new land and plantation cald watermillin point for the said use and appointments ~ Item if these should be no Ocation for my said Ex Ex to sell the said land called watermillin point then I will and devise the said land to my daughter Martha Osburn to her hfs and incase of her mortality before she shall arrive at the age of seventeen years or be married then the said land to revert to the survivour that is to say the mother or child that she now goes wth to them or either of them (?) ~ Item I will that my said daughter Martha Osburn shall be capable of entering upon or receiving and sharing her said estate reall or psonall when she shall marry or arrive at the age of seventeen years ~ Item I will that iff the child lives that my wife is wth be a girle she the said child shall enjoy and (?) her estate (?) when either she shall marry or arrive at ye age of seventeen ~ Item Iff the said child should be a boy that he shall be and arrive at his full age at twenty years, and enter upon receive and enjoy what estate deserved to him as heir to ye Item I will that a divendand of land said to James Duncan be firm and should gead and I bequeathe the said peace of land to the said Duncan provided he the said James Duncan (?)(?)(?) shall pay my Executrix ~ Item I will that Mitchell (?) and (?) Spence (?) good title to their land avoiding to bargain each of them one hundred acres ~ Item I will that John Levine have good title to his land he paying according to bargain ~ Item I will that Joseph Light have and enjoy good title to (?)(?)(?)(?)(?)(?)(?)(?) he paying what is due upon balance ~ Item I will that Sylas Chpman have good right and title to eight hundred and fivety acres of land when he has (?) and done the work for ye same according to bargain ~ Item I will that if the said Sylas Chapman shall rest (?) his work or relinquish that bargain that then that dividend I bequeath to Martha Osburne or iff the child my wife is wth lives then to them both to be divided as equally as can be between them or wholly in case off (?) mortatlity to ye (?)(?) theirs or each of their heirs ~ Item I will that my said wife and Executrix have the (?)(?)(?) and ordering off my said child Martha and other child iff live till they or each of them arrive at their her of his respective age or ages ~ Item In case my said wife and executrix shall dye during the minority off my child or presumed children then I constitute or devise and appoint my loving brother Thomas Willburne in her stead and place as ample and as (?) and to all intents and purposes and in as full person as I gave to my said Executrix In witnefs where of I have here unto put my hand and seal Signed sealed and delivered before us John Osborne {(?) seal}
