In the name of God Amen I James Whittington of Somerset County in the
State of Maryland being weak of body but of perfect mind & memory do
make and ordain this my last will & testament in the following manner &
form First I give & bequeath to my Son John Whittington A part of A
tract of land called puzzel bounded as follows begin- ning at the Road
gate leading to my House thence with A line drawn Southwardly to A pine
tree thence with a straight line Southwardly to A Ceder post set up by
the side of A great ditch thence Eastwardly with said ditch to A flood
gate thence with said ditch northwardly un- till it intersects A tract
of land called middle Ridge thence with said tract of land called middle
Ridge to the school House lot thence to the County Road thence with the
County Road to the beginning one Yoke of oxen one cow & calf one bed and
furniture to him and his heirs and assigns forever in fee simple
Secondly I give and bequeath to my Son Theodore Whittington A part of A
A tract of land called puzzel bounded as follows beginning at A Ceder
post by the side of A great ditch to the Eastward of the head of the
buck Ridge thence north- wardly through the middle of the apple Orchard
with A straight line to George W Lankfords leading ditch thence with
said ditch to said Lankfords fence thence with said fence to the County
Road thence with the line of John Whittingtons land to the beginning
Ceder post at the great ditch near the head of the buck Ridge to him and
heirs and assigns forever in fee simple by his paying the sum of two
Hundred dollars into my Estate Thirdly I give and bequeath to my Son
Henry Whittington A part of A tract of land called Puzzel bounded as
follows beginning at A Ceder post by the side of A great ditch thence
Westwardly with said ditch untill it intersects the land of William C
Rell thence Northwardly with said Rells land to where Theodore
Whittingtons land cuts the ditch of George W Lank- ford thence with said
Theodores land to the beginning Ceder Post at the great ditch also
another part of the said tract of land called puzzel at the Eastward End
of said land C 1815-9
beginning at a White oak stump thence running with the line of Middle
Ridge on a straight line to dickersons lott belonging to Saml Muir shall
make ten acres of land to have his heirs & assigns for Ever in fee
simple, by his paying the sum of one Hundred & sixty dollars into my
Estate and to have a free pass way to said land Fourthly I give and
bequeath to my following named Children Asah Whittington William F
Whittington Eliza J Bratton Sarah A. Whittington Cornelia Whittington
Mary E Whittington Martha P. Whittington all the Ballance of my Estate
Real personal & mixed to be Equally divided between them share and share
alike after the payment of all my Just debts the land to be divided
between them according to the number of acres Each ones share may be to
them their Heirs and assigns forever in simple Lastly I hereby ordain
and appoint my son Theodore Whittington my sole Executor of this my last
will and testament and I hereby utterly disallow revoke and disannul all
and every other former wills legacies bequests and Executors by me in
any way before named willed bequeathed Ratifying and confirming this and
no other to be my last will and testament in witness whereof I have
hereunto set my hand and seal this sixth of September in the year of our
Lord one thousand Eight Hundred and fifty one Signed sealed published
pronounced and declared by the said James Whittington as his last will
and testament in the presence of us who in his presence and at his
request and in the presence of each other have hereunto subscribed our
names, Benjamin Lankford John J. Bell Elisha J Gunby James Whittington
(Seal) Somerset County to wit November 22nd day 1853 - Then came
Theodore Whittington and made oath on the Holy Evangely of Almighty God,
that the foregoing instrument of writing is the true and whole last will
and testament of James Whit- -tington late of Somerset County, deceased,
that hath come to his hands or possession and that he doth not know of
any other Before S. W. Jones Reg W.S.C. Somerset County to wit November
22nd day 1853 - Then came Benjamin Lank- -ford and Elisha J Gunby two of
the subscribing witnesses to the foregoing last will and testament of
James Whittington late of Somerset County, deceased, and severally made
oath on the Holy Evangely of Almighty God, that they did see the
Testator therein named sign and seal this will, and that they heard him
publish pro- -nounce and declare the same to be his last will and
testament; that at the time of his so doing he was to the best of each
of their apprehensions of sound and disposing mind, memory and
understanding, capable of executing a valid deed or contract; and that
they subscribed their names as witnesses to this will in the presence
and at the request of the Testator They further depose that they did see
John J Bell subscribe his name as a witness to this will in the presence
and at the request of the Testator Recorded in Liber J.P. No 5 Folios
