Transcription
In the name of God Amen I George Gale of Somerset County in the Province of
Maryland being of Good sound and disposing mind and memory do make and
ordain this my Last Will and Testament in manner and form following ______
Imprimis I Desire that all my Just Debts be paid ______ Item I Give and
Desire unto my Nephew Levin Gale the Elder and to his Heirs and Afsigne for
ever all my Lands with the appurtenances Situate Lying and Being in
Somerset County unlefs the Such part thereof as shall Lye to the
Westernmost Side of a line to Begin at the mouth of the Ditch at the back
of my Negro Quarter from thence Runing with the Said Ditch untill it forks
wch is about Eighty yards above my Barn and from thence to Run untill it
intersects the Line of the Tracts of Land where on I Live called addition
so as to Leave five Hundred Acres to the Westward of the Said Lines which
five Hundred Acres of Land with the appurtenances I give and devide unto my
Nephew Liven Gale the Son of John and his Heirs and Afsigns for ever I give
unto my Nephew Henry Gale Five Hundred pounds to be paid him in Dollars at
Seven Shillings and Six pence each or Pistoles at twenty Seven Shillings
each But it is my will that two Hundred and Sixty five pounds which He Has
had of me and for which I have his Note be considered as a part of that
Sum______ I give unto Magaret Denwood Forty pounds to be paid in Dollars at
Seven Shillings and Six pence each or Pistoles at twenty Seven Shillings
each I also give unto the said Margaret One Bed and Furniture of the value
of Ten Pounds I give Twenty Pounds to be laid out by my Executor here after
named among such as shall to him appear objects of Charity within this
Parish I give the Residue of my personal Estate to be disposed of in the
following manner Viz one Seventh part to Leah Gale wife of Levin one
Seventh part to Henry Gale One Seventh part to Levin Gale Son of John One
Seventh part to Mary Wilson Wife of Samuel One Seventh part to Amelia
Forman wife of Jofeph one Seventh part to be Equally divided Between Mileah
Gale George Gale Elizabeth Gale and Leah Gale Children of my deceased
nephew Gorge Gale provided the Boy Arrive the Age of twenty one years and
the Girls to the Age of Sixteen and in case of the Death of any of them
before that age it is my Desire that the Survivors have Equally their part
among them Lastly I hereby nominate Conftitute and appoint my Nephew Levin
Gale the Elder whole and Sole Executor of this my Last Will and Testament
Hereby Revoking and making void all other and former Wills by me made In
Witnefs where of I the said George Gale have hereto Set my Hand and affix'd
my Seal this Eleventh day of January

On the 11th day of January 1772 Came Levin Gale and made oath on the Holy
Evangelist of Almighty God that he Believed that the afforegoing Inftrument
of Writing to be the Last Will and Testament of George Gale Late of
Somerset County deceased that hathe Come to his hands or pofsefsion, and
that he belived it is free from any Interlining Erasures Or any alterations
whatsoever Since the Executor there of, and that he did not know or had any
Just Reason to Belive that there is any other since the Date thereof ~
Sworn Befor Thos Holbrock Depy Comy of Som County On the Eleventh day
of Janurary One thousand Seven Hundred and Seventy two Came Mary Surman Ann
Day Scott, Alias Jones and Henry Jackson the three Subscribing Witnefs: to
the Aforegoing Will and made Oath on the Holy Evangelist of Almighty God
that they did See the Testator George Gale Sign and the Aforegoing Will and
heard him Publish pronounce and Declare the Same to be his Last Will and
Testament and the time of his Sodoing he was to the best of there
Apprehansions of a Sound Disposing mind memory and understanding and that
they Subscribed there Names as Witnefs: to the Said Will In the presence of
the Said Testator
