In the name of god Amen this fourteenth day of January One Thousand Six hundred and Eighty years I David Lindsay of the County of Somerset in ye Province of Maryland Planter being at this present time weak of body but of Sound and perfect Memory thanks be to Almighty god and calling to remembrance the uncertine Estate of this Transitory Life and that all flesh must yield unto death when it shall please god to call do Make Constitute and apoint this my Last will and Testament in Manner and form following, Revoaking and adnulling by these presents all and every Testament Will and Wills, heretofore Made by me and declared either by word or writing and this to be taken Only for my Last will and Testament and None other and first being penitent and Sorry from the bottom of my hart for my sins past Most humbly diserving, forgivness for the same, I give and comand my Soul to Almighty God, my Saviour and redeemer, in whom and by the Merrits of Jesus Christ and asuredly believe to be saved and to have full remission and forgiveness of all My sins and that my soul wth my body at ye Great day of resurrection shall rise again wth Joy and through the Merrits of Christ death and passion shall possess and Inheritt the Kingdom of heaven Prepared for his Elect and Chosen And my Body to be burried in such conveinent place as it shall please my Executor hereafter named to apoint And now for Setting my present Estate and Such goods Chattles & Debts as it hath pleased god far above my deserts to be stow upon me soo order give & bestow dispose and bequeath the same In Manner and form following that is to Say, First I will that all those Debts I owe in Conscience to any Manner of persons shall be well and Freely Contested & paid to wthin Convient time after my deceased by my Exectr hereafter Named First I give and bequeath the Three hundred Acres of Land Lying on pokemoke River to be Equally divided Amongst my Wife Sarah Lindsay and my Two Children Lawfully begotten, betwixt my said Wife Sarah and me I say Equally (Shoires ?) amongst them, Likewise I will and disire that what creatures as Horses Mares Cattle and Hoggs my be Equally devided betwixt the said Sarah and my Two children as also what Moveables or houshold staff I have may in Lehemaner be Equally devided Amongst them as also I will and desire that my well beloved friend James Langster Writer hereof may have One black yearling Heifer wth a star in her fore head and the tipe of her tail White, the Next Spring after ye date of these prisents Lastly I will and desire that ye of Colll Wm Stevens Esqr may be and become my Executor disering by this my Last will and Testament that my sd Executor doe Well and Truly see that this my Last Will be duly performed According to ye True Intent and Meaning of these presents And that my Sd Executr may have a Special Care of my Children that they be not Wronged And this I declare as my Last Will and none other Witness my hand and Seale the above said day and year ~~~~ Test Ja: Langster his Philip P Conah David I Lindsay Seal Mark Sign Wm Batchelor Edward Harper Maryland Somerset County p. To the Hon: Phillip Calvert Esqr Judge or Comissary Gen for Probates of Wills and Granting Adms withen this province afsd These are Humbly to Cert: that in Obedience to a power Received dated the 20th day of September in the Sixth year of the dom of the Right Honble Charles Ano Dom 1681. under the seal of the office for probits of Wills (?): I have Summoned James Langster, Phillip Conah Wm Bachelor and Edwd Harper Wittnesses to the within Mentioned Will and Testament of David Lindsay Decd and the sd James Langster upon the 8th day of Octr Ano Dom 1681 and the Sd Phillip Conah upon the 11th day of Octob: 1681 And the Sd Wm Bachelor upon the (?) 11th day of Octobr Anno Dom 1681 and the sd Edward Harper upon the 19th day of Oct Anog: Dom 1681 ~~~ Being Severally Sworn and Examined the day and year abovesd did upon the Holy Evangelists declare that they the sd Jas Langster Philip Canah Wm Bachelor and Edward Harper did see David Lindsay decd Sign Seal & Deliver the within Mentioned Will and Testament as his act and deed and that the sd James Langster Philip Canah Wm Bachelor and Edward Harper did as Witness there unto Make there Several Subscriptions as it is Within Written. Taken before me on the Days and year abovesd as Witness my hand and Seal this 19th day of Novembr in the 6th year of the Dom of the Right Hble Charles (?) Ano Dom 1681 Francis Jenkins Seal
