In the name of God, Amen I Charlotte Smith of Somerset County, in the
State of Maryland, being sick and weak in body but of sound and
disposing mind, memory and understanding considering the certainty of
death and the uncertainty of the time thereof, and being desirous to
settle my worldly affairs and thereby be the better prepared to leave
this world when it shall please God to call me hence, do therefore make
and publish this my last will and testament, in manner and form
following that is to say -
First and principally I commit my soul into the hands of Almighty God
and my body to the earth to be decently buried at the discretion of my
executor herein after named and after my debts and funeral charges are
paid I devise and bequeath as follows - Item. I give and devise unto
Susan Anne my eldest daughter one negro girl named Flora to her the said
Susan and her heirs and assigns forever - Item I give and devise unto
Sarah Ann my second daughter one negro boy James to her the said Sarah
and her heirs forever - Item I give and bequeath unto my two sons, Elias
and Benjamin, and James Parker, one hundred dollars each. Item I devise
and bequeath all the rest and residue of my estate, both real and
personal to be sold (my negroes excepted) and the proceeds of such sale
to be equally divided among my sons Elias, Benjamin, and James Parker
and two daughters Susan Anne and Sarah Ann in equal portions share and
share alike - And lastly, I do hereby constitute and appoint Samuel S.
Boggs to be the sole Executor of this my last will and testament;
revoking and annulling all former wills by me heretofore made, ratifying
and confirming this and none other, to be my last Will and Testament. In
testimony whereof I have hereunto set my hand and affixed my seal this
third day of June in the year of our Lord one thousand eight hundred and
forty three
- Signed, sealed, published and declared by Charlotte Smith the above
named testatrix as and for her last Will and testament in the presence
of us, who at her request in her presence and in the presence of each
other have subscribed our names as witnesses thereto Charlotte Smith
(Seal) Margaret I Milbourne - T. S. Gibbons - Sarah B Beauchamp. We
further certify that the words or sentences between the twentieth and
twenty first lines of the first page was interlined before the execution

Samuel S. Boggs, and made Oath on the Holy Evangely of Almighty God,
that the foregoing instrument of writing is the true and whole last will
and testament of Charlotte Smith, late of Somerset County, deceased,
that hath come to his hands or possession & that he doth not know of any
other - Before James Polk Reg W.S.Co. Somerset County, to wiAt: - August
the 17th day 1848 - Then came Margaret I Milbourne, and Theodore S
Gibbons, two of the subscribing witnesses to the foregoing last will and
Testament of Charlotte Smith, late of Somerset County, deceased, and
severally made Oath on the Holy Evangely of Almighty God, that they did
see the Testatrix therein named, sign and seal this will, and that they
heard her publish, pronounce and declare the same to be her last Will
and Testament; that at the time of her so doing she was to the best of
each of their apprehensions of sound and disposing mind, memory and
understanding, capable of executing a valid contract; and that they
respectively subscribed their names as witnesses to this will in the
presence and at the request of the Testatrix and in the presence of each
other. They further deposed that they saw Sarah B Beauchamp subscribe
her name as a witness to this will in the presence and at the request of
the Testatrix Recorded in Liber J.P. No. 5. folio 60. Before James Polk
